1. Controller and General Principles of Data Processing
flexis AG, Industriestraße 6, 70565 Stuttgart (“we”, “us”, the “controller”), as the operator of the website "https://www.flexis.com" and its subsites (hereinafter also referred to as the "website") is the controller of personal data processed of our website’s users ("you" or “data” subject”) within the meaning of the European General Data Protection Regulation (“GDPR”) and other applicable data protection laws.
Your trust and the protection of your privacy is of our special concern. We therefore take the protection and security of your personal data very seriously. Your personal data will be processed exclusively in compliance with the applicable data protection laws.

Below, we would like to inform you in detail about which of your personal data is being processed when you visit our website.
2. Collection and use of your personal data when visiting the website (storage of log files)
When you use our website for purely informational purposes, we may collect the following data that your browser transmits to our server (server log files). Each time you visit our website, a range of general data and information is collected. Information that we store in the server log files. The purpose of processing is the correct delivery and to optimize the content of our website, ensuring the continued operability of our IT systems and website technology. We e.g. may use the data for

The processing of your logfiles is legitimate based on our legitimate interest (Art. 6 I 1 f) GDPR), consisting in the stability of our website, the provision of information to authorities in the event of a cyberattack, improving the level of data protection and security level and the correct presentation of content.
Logfiles will be retained for 7 days.
3. Contact with flexis
3.1 Via email or phone
If you contact flexis via email phone the data provided to us will be processed. In particular, this may involve the following data:
- Your name
- Role
- Email address
- Contact data
- Information about the company you work for
- Everything else you provide to us
The legal basis for the processing of the data is Article 6 I 1 b) or f) GDPR. The processing is carried out only to respond to your queries and/or suggestions made via email and thus is in our legitimate business interest.
The data will be deleted as soon as it is no longer required to achieve the purpose for which it was collected if no retention period apply.
3.2 Contact form
If you contact us via our contact form, we require the following data from you:
- Your full name
- Email address
- Information you provide to us
The legal basis for the processing of the data is Article 6 I 1 b) or f) GDPR. The processing is carried out only to respond to your queries and/or suggestions made via email and thus is in our legitimate business interest.
The data will be deleted as soon as it is no longer required to achieve the purpose for which it was collected if no retention period apply.
3.3. Newsletter
If you would like to sign up to our newsletter, please fill in the contact form and click the box below to opt-in. We use your name and company information so that we can personalize the sending of the e-mails with a direct salutation.
If you register online for the newsletter, you will receive an e-mail at the address you have provided in which we ask you to confirm your registration. This two-step process is called double opt-in for double consent.
By subscribing to our newsletter, you consent to us sending you emails on the subject matter described on the subscription page according to Art. 6 I 1 a) GDPR.
You can revoke your registration and thus your consent at any time for the future. This is possible via the unsubscribe button at the end of each newsletter or via email addressed to request@flexis.com.
We record the use of our newsletter via so-called counting pixels and campaign URLs for the internet links in the newsletter. The counting pixel calls our newsletter server when you open the e-mail. The call of the internet links in the newsletter is recorded via the campaign mapping in our web analytics. Purpose is to optimize the content of our newsletter. We use the services of Hubspot (please see section 10) for the sending and evaluation of the newsletter.
We may process the same data as within the contact form (please see section 3.2) plus the following information:
- documentation of email verification (double opt-in),
- time of your registration;
- usage data (opening the email + clicking on internet links).
After revocation of your consent, your data will be deleted immediately.
3.4 Demo request
If you request a demo, we request information from you via a contact form. We explicitly ask you for your consent to process the following data:
- Your full name
- Job function
- Email address
- Phone number
- Your company name
- Information you provide to us
The processing of data is legitimate according to Art. 6 I 1 b) GDPR, as we are providing you with a pre contractual service. We use your data for providing you the requested demo. After submitting the form, we will send you an e-mail in which you can confirm your e-mail address and the demo request by clicking on the confirmation link.
If you have confirmed your e-mail address as described above, we may also provide you with further emails referring to similar digital content you downloaded and offers related to the products and services of flexis and Blue Yonder group. Our direct marketing purposes are generally based on your consent. We rely also on our legitimate interests to contact you to offer related services that may be of interest to you based on the services and products that you may have bought from us or related to the resource that you have requested from us. You always can opt-out or withdraw your consent at any time with effect for the future by sending an e-mail to request@flexis.com or by clicking the unsubscribe button in each email received.
We store your data in Hubspot. Please read section 10 of this Privacy Statement for further information.

4. Use of cookies and other technologies

5. Matomo
We use the services of Matomo. Matomo analytics is an open-source web analytics platform used to measure, collect, analyse and report visitors’ data for purposes of understanding and optimizing the website.
Matomo is used to analyse the behaviour of the website visitors to identify potential pitfalls; not found pages, search engine indexing issues, which contents are the most appreciated. Once the data is processed (number of visitors reaching a not found pages, viewing only one page…), Matomo is generating reports for flexis to take action, for example changing the layout of the pages, publishing some fresh content etc., The data processed will be stored on flexis’ own servers and with the function anonymous IP.
Matomo may process the following personal data:

- Title of the page being viewed
- URL of the page being viewed
- URL of the page that was viewed prior to the current page
- Screen resolution
- Time in local timezone
- Files that were clicked and downloaded

The processing of personal data with Matomo is based on explicit consent according to Article 6 Abs. 1 lit a GDPR. You can revoke your consent at any time with effect for the future.
The data is stored as long as necessary for the mentioned purpose.
6. Google Maps
This site uses links to the map service Google Maps via an API. Provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA to be contacted in Europe via Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

8.1 Blog post comments
The comment function in our blog allows you to comment on flexis’ blog posts. The use of this comment function requires the input of a name whereby you can also choose a pseudonym. Next, you must enter an e-mail address. It is necessary to provide an e-mail address so that we can pass on any objections to your blog comments and ask you for an opinion. It is not possible for you to use the comment function without this information. When you publish your comment, the e-mail address you provided will be stored by flexis but not published. Your name will be published if you did not use a pseudonym.
Legal basis for the processing of the data transmitted when using the comment function for blog posts, is, if and insofar you consent, Art. 6 I 1 a) GDPR as well as our legitimate interest Art. 6 I 1 f) GDPR. You can withdraw your consent at any time with effect for the future.
The data provided by you will be used for the sole purpose of forwarding any complaints about your blog comments and to request your opinion on this. In the case of complaints, we can, assuming the complaints are justified, even be prosecuted for the comment under certain circumstances, and therefore have a legitimate interest in knowing the identity of the author.
The data will be deleted as soon as they are no longer needed to achieve the purpose of their collection, for example, when the conversation with you about the complaints has ended and your comments have been clarified.
In such a case, however, the comment function cannot be used any further.

9. Free content, e.g. White Papers, Events, Case Studies
We may request information from you via forms at various points on our website. If you are interested in our marketing material or other free digital content on our website, like white papers, case studies and event invitations we explicitly ask you for your consent to process the following data: business email address, name and surname as well as information on your company.
We use your data for providing you the requested digital content by e-mail. 10. Hubspot
The personal data collected via the website forms or provided via email described may be stored in our customer relation management system and marketing automation platform or comparable inquiry organization(“CRM”).
We use the CRM, registration and marketing automation system "HubSpot" of the provider HubSpot Inc. (25 First Street, 2nd Floor, Cambridge, MA 02141, USA) with offices in Ireland (One Dockland Central, Dublin 1, Ireland) and Germany (Unter den Linden 26, 10117 Berlin) on the basis of your explicit consent according to Art. 6 I 1a) GDPR or our legitimate interests (efficient and fast processing of user inquiries, applications and optimization of our online offer) according to Art. 6 I 1f) GDPR.
It serves to manage and execute our inbound marketing. It provides statistical analyzes and an evaluation of logged user behavior. That way we can align our marketing even better with your needs. If we provide you with our marketing emails, we e.g. may evaluate, if you have opened the email and which kink you clicked.

11. Third-party Transfer

The legal basis for the transfer of your data in this case is Art. 6 I 1 a) GDPR, insofar as you have given your consent. You can withdraw your consent at any time with effect for the future. If the forwarding is necessary for the execution of the contract, the processing is legitimate according to Art. 6 I 1 b) GDPR. flexis also has a legitimate interest in providing its customers the best possible service by including the Blue Yonder group entities according to Art. 6 I 1 f) GDPR. It is also in our legitimate interest to inform existing customers about latest offers and promotions about new flexis respectively products and services of Blue Yonder group when carrying out direct marketing.
The data will be deleted if it is no longer required to achieve the purpose and there are no statutory retention obligations.
This will include transferring your personal data to countries which have laws that do not provide the same level of data protection as the GDPR. When we do so we ensure that an adequate level of data protection is afforded to it by ensuring appropriate safeguards.

11.2 Other third-parties
We may also share your data with our contracted service providers based on data protection agreements, which provide services such as IT and system administration or hosting, research and analytics, marketing, customer support and data enrichment for the purposes and pursuant to the legal bases described in this privacy statement.
This will include transferring your personal data to countries which have laws that do not provide the same level of data protection as the GDPR. When we do so we ensure that an adequate level of data protection is afforded to it by ensuring appropriate safeguards.
